1. By entering this competition, each entrant agrees to have read and be bound by these terms and conditions and Flickr's Terms of Service available at www.flickr.com.
2. No purchase necessary to enter the competition.
3. This competition is open to Australian and New Zealand residents ONLY with the exception of employees of the Promoter, their families, agents and anyone else connected with this promotion. Entries from those aged under 18 years must be submitted by a parent or guardian on behalf of the entrant.
4. Go to www.peterrabbit.com.au/au/naturallybetter/mypatch.asp and click on the link to submit your photo the Flickr My Patch gallery page by no later than midnight Australian Eastern Standard Time (AEST) on Monday 30 November 2009.
5. The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the Promoter by the relevant closing date for any reason. Proof of sending is not proof of receipt. Entries via agents or third parties are invalid. Entries become the property of the Promoter and are not returned.
6. Only one entry per person. No entrant may win more than one prize.
7. Entrants can submit up to 10 garden photographs in their entry on the My Patch gallery page of the Flickr website. The Promoter will not accept any duplicate photographs in an entry.
8. To enter, take a photograph(s) of your own garden or allotment. You must upload your entry onto the My Patch Flickr gallery page as promoted on www.peterrabbit.com.au/naturallybetter. If you do not already have a Flickr account, you will need to set up a free Flickr account to upload your photographs. Photographs must be in jpeg format and uploaded as per Flickr’s Terms of Service.
9. You agree not to include in your entry any content which is unlawful, defamatory, obscene, threatening, offensive, harmful, or otherwise objectionable, or which advertises, promotes or offers for sale any goods or services; or uses inappropriate or offensive language. .
10. All correctly uploaded photographs will be displayed on the My Patch gallery page of the Flickr website and viewed by a judging panel made up of Frederick Warne staff. The winner will be judged at 250 Camberwell Road, Camberwell Victoria on Friday 4 December 2009. The winner will be the entry that in the opinion of the judges includes a photograph that best celebrates the entrant’s own gardening achievements. The judges’ decision is final and no correspondence will be entered into.
11. The prize for the winner is $500rrp worth of gardening books and a selection of Peter Rabbit Naturally Better books. The runners-up prize is 2 Peter Rabbit Naturally Better books including Peter Rabbit Naturally Better I Love You and Peter Rabbit Naturally Better Peekaboo! valued at a total of $33.90rrp. There are 10 runners-up prizes to be won. The total prize value on offer is AUD$839.00rrp.
12. The prizes are not transferrable and not redeemable for cash or any other goods or services, unless otherwise stipulated. Prizes will only be delivered in Australia or New Zealand and each winner should allow 28 days from the date the prize was drawn for delivery of their prize.
13. In the event that a prize item is unavailable despite the Promoter’s reasonable endeavours, the Promoter reserves the right (a) to substitute alternative prizes of equivalent or greater value and (b) in exceptional circumstances to amend or foreclose the promotion without notice. No correspondence will be entered into.
14. The winner and runners-up will be notified via email or via Flickr mail on Tuesday 8 December 2009. The winner and runners-up must claim their prize within 14 working days of the Promoter sending notification. If the prize is unclaimed after this time, it will lapse and the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected in accordance with these rules. The winners names will be available from www.peterrabbit.com.au on Wednesday 9 December 2009.
15. By entering this competition each entrant confirms that his/her entry is their wholly-owned creation and to the extent that such entry makes use of any third party materials that these have been fully cleared unless they are no longer protected by copyright or other intellectual property rights. Entrants will keep the Promoter harmless from any claims in relation to their entry that the entry infringes the personal or proprietary or privacy right of any other person or third party. By submitting an entry, each entrant (or their parent/guardian on their behalf) grants to the Promoter a perpetual, royalty-free, non-exclusive licence to edit, publish, translate, modify, adapt, make available and distribute the entry throughout the world in any media now known or hereafter invented. Each entrant (or their parent/guardian on their behalf) undertakes to complete any necessary documentation to formalise the licence. If you do not want to grant us these rights, please do not submit materials to us.
16. If for any reason the competition is not capable of running as planned, whether caused by infection by computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the competition, the Promoter reserves the right in its discretion (subject always tot any direction given by a relevant gaming or lotteries authority) to cancel, terminate, modify or suspend the competition. The Promoter may in its discretion disqualify any individual who tampers with the entry process.
17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) technical malfunction of any telephone, telephone or computer network, or lines, servers, or telecommunication providers, traffic congestion on any of these, or any combination, including any injury or damage to entrants or any handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this competition; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize.
18. The Promoter will use any data submitted by entrants only for the purposes of running the competition, unless otherwise stated in the entry details. By entering this competition, all entrants consent to the transfer of their personal data to the Promoter for the purposes of the administration of this competition and any other purposes to which the entrant has consented.
19. The winner and runners-up agree to take part in reasonable post event publicity and to the use of their name and photograph in such publicity.
